exposurelieswiththeentitiesauthorizingtribalpoliceofficersasgeneralWashington
statepeaceofficers.Itshouldbenotedthatthenewlawdoesnotprohibitasheriffnora
municipalpolicechieffromcommissioningtribalofficers;howeverliabilitywouldattachto
thecommissioningauthorityinthosecircumstances.Ifasherifformunicipalpolicechief
wishestocommissiontribalofficersinthismanner,thecommissioningauthorityshould
considerincludingaprovisionrelatingtowaiverofsovereignimmunitybythetribeand
requirementsforinsuranceasprovidedinthenewlaw.
8. Renegotiationandlengthoftermoftheinterlocalagreementshouldbeincluded.Itshould
specifythelengthoftermoftheagreementandwhethertheagreementremainsinforceif
anewlawenforcementexecutivetakesofficeoruntilrenegotiationoradjudicationoccurs.
Partiesmayalsoincludeprovisionsthatprohibitanewlawenforcementexecutivefrom
unilateralrescissionofaninterlocalagreement.Itmayalsostatethattheinterlocal
agreementautomaticallyremainsineffectunless,onanannualbasis,onepartyformally
objectsandseeksamodification.Partiesshouldconsiderdevelopingaclauseprovidingfor
arbitrationifnonewagreementcanbereachedafteranewlawenforcementexecutive
takesoffice,and/ordefinewhenmandatoryarbitrationwillcomeintoeffectduring
renegotiation.
9. Mutualaidprovisionsshouldbeincludedwithreferencetofirstrespondersand
investigations(RCW10.93.070).
10. Processesforcommunicationandcooperationbetweenofficersandcommunitiesshould
bedelineated.Thisshouldincludeanydesiredrequirementsoninformationsharing,
annualreports,sharingofcrimestatistics,andpublicmeetingsorotheroutreachefforts.
11. TheagreementshouldoutlineanyapplicablejointtrainingregardingtheILA,cultural
education,PL280andjurisdictionalissues,FourthAmendmentandprivacyrightsissues
(theIndianCivilRightsAct/WashingtonStateConst.Art1.Sec.7),tribalfishandwildlife
enforcement,ortribalgamingmatters.
12. Theuseofjailsshouldbeaddressedincludingbookinglocationsandintakestandards;
reportsanddocumentationandprisonertransportation.
13. Agreementsshouldclearlyarticulatetheparties’responsibilitiesregardingcosts
associatedwiththecriminaljusticeprocessincludingjailbookingfees,transportfeesand
medicalcostsandotheritemsasdeterminedbytheparties.Provisionsshouldincludehow
feeswillbenegotiatedandtheprocessforresolvinganydisputedfeesorotherjailcosts.
Agreementsmayneedtoincludeapartialwaiverofsovereignimmunitybythetribeto
ensuretheabilityofacityorcountytocollectanyamountso
wedforsuchcostsandfees.

14. Agreementsshouldconsiderstandardsforuniformincidentreporting,reportingtimelines,
andgeneralmanagementandsharingofinformation.
15. Theroleofprosecutorsandcourtsmaybeincludedinanyagreement,includingstandards
orguidelinesfordeterminingwhichcourtwillbetheappropriatevenue.Provisionsthat
providethatthepartieswillenterintoaseparateILAonprosecution/courtcostsmaybe
