CITY OF PRINCE GEORGE
BYLAW NO. 8813, 2016
A Bylaw to establish a process for enforcing bylaws through the issuance of a Bylaw Notice in
conjunction with the Prince George Bylaw Notice Dispute Adjudication Registry, and to designate those
City Bylaws that are enforceable under the
Local Government Bylaw Notice Enforcement Act
.
WHEREAS the Council of the City of Prince George wishes to establish a process for Bylaw Enforcement
through the issuance of Bylaw Notices;
AND WHEREAS the Council of the City of Prince George wishes to authorize the enforcement of Bylaw
Notices in conjunction with the Prince George Bylaw Notice Dispute Adjudication Registry;
AND WHEREAS pursuant to Section 2(2) of the Local Government Bylaw Notice Enforcement Act and
regulations thereto, the Council of the City of Prince George may, by bylaw;
a) designate bylaw contraventions that may be dealt with by Bylaw Notice,
b) establish the amount of the penalty for a contravention referred to in paragraph a),
c) establish the period for paying or disputing a Bylaw Notice, and
d) establish and participate in a Bylaw Notice dispute adjudication system to resolve disputes in
relation to Bylaw Notices;
NOW THEREFORE, the Council of the City of Prince George, in open meeting assembled, enacts as
follows

SECTION 1
CITATION
1.1
This Bylaw may be cited as the "City of Prince George Bylaw Notice
Enforcement Bylaw No. 8813, 2016".
SECTION 2
DEFINITIONS
2.1
In this Bylaw:
"Act"
means the Local Government Bylaw Notice Enforcement Act,
as amended from time to time;
"City"
means the City of Prince George; and
"Registry"
means the City of Prince George Bylaw Notice Adjudication
Registry established pursuant to this bylaw.
SECTION 3
TERMS
3.1
The terms in this bylaw have the same meaning as the terms defined
in the Act.
SECTION 4
BYLAW CONTRAVENTIONS
4.1
The bylaws and bylaw contraventions designated in Schedule “B”
attached hereto and forming part of this bylaw, may be dealt with by
Bylaw Notice.

SECTION 5
PERIOD FOR PAYING OR DISPUTING A NOTICE
5.1
The penalty for a contravention referred to in SECTION 4 - BYLAW
CONTRAVENTIONS
is as follows:
a) If received by the City within thirty (30) days of the person
receiving or is presumed to have received the Bylaw Notice,
is the Payment Penalty set out in Column A1 of Schedule
“B”; or
b) If received by the City more than thirty (30) days after the
person received or is presumed to have received the Bylaw
Notice, is the Late Payment Penalty set out in Column A2 of
Schedule “B”.
SECTION 6
PERIOD FOR PAYING OR DISPUTING A NOTICE
6.1
A person who receives a Bylaw Notice must:
a) Within thirty (30) days of the date on which the person
received or is presumed to have received the Bylaw Notice,
pay the penalty amount in accordance with subsection
5.1(a) in the matter described on the Bylaw Notice; or
b) Within fourteen (14) days of the date on which the person
received or is presumed to have received the Bylaw Notice,
request dispute adjudication in writing and delivering it,
either in person during regular office hours, or by mail, to the
City of Prince George Bylaw Services Division. (1100 Patricia
Boulevard, Prince George, British Columbia, V2L 3V9).
6.2
A person may pay the indicated penalty after thirty (30) days of
receiving the notice, in accordance with subsection 5.1(b).
6.3
No person may dispute a Bylaw Notice after fourteen (14) days of
receiving or being deemed to have received the Bylaw Notice.
6.4
Pursuant to the requirements of Section 25 of the Act, if a person
who was not served personally with a Bylaw Notice advises the City
that they did not receive a copy of the original Bylaw Notice, the time
limits for responding to a Bylaw Notice under SECTION 5 – OFFENCE
AND PENALTY and SECTION 6 - PERIOD FOR PAYING OR
DISPUTING A NOTICE
Subsection 6.1 of this bylaw do not begin to
run until a copy of the Bylaw Notice is redelivered to them in
accordance with the Act.
SECTION 7
BYLAW NOTICE DISPUTE ADJUDICATION REGISTRY
7.1
The Registry is established as a Bylaw Notice dispute adjudication
system in accordance with the Act to resolve disputes in relation to
Bylaw Notices.
7.2
The civic address of the Registry is the City of Prince George,
1100 Patricia Boulevard, Prince George, British Columbia, V2L 3V9.

7.3
Every person who is unsuccessful in a dispute adjudication in
relation to a Bylaw Notice or a compliance agreement under the
dispute adjudication system established under this section must pay
the City
an additional fee of $25 for the purpose of the City
recovering the costs of the adjudication system.

SECTION 8
SCREENING OFFICERS
8.1
The position of Screening Officer is established.
8.2
The following employees or officers are appointed as Screening
Officers:
a) Manager of Bylaw Services;
b) Corporate Officer;
c) General Manager of Community Services;
d) General Manager of Planning and Development;
e) Parking Control Supervisor;
f) Court Coordinator / Senior Bylaw Officer;

h) Animal Control Officer

i) Bylaw Enforcement Officer
or a person designated in writing by any of the above employees or
officers to carry out any act or function under this Bylaw.
SECTION 9
POWERS, DUTIES AND FUNCTIONS OF SCREENING OFFICERS
9.1
The powers, duties and functions of Screening Officers are as set
out in the Act, and include, without limitation, the following powers:
9.1.2
To communicate with any or all of the following for the purposes
of performing their functions under this Bylaw or the Act:
i. the person against whom a contravention is alleged
or their representative;
ii. the officer issuing the notice;
iii. the complainant or their representative;
iv. the City’s staff regarding the disputant’s history of Bylaw
compliance.
9.1.3
To prepare and enter into compliance agreements under the
Act
with persons who dispute Bylaw Notices, including to establish
terms and conditions for compliance that the Screening Officer
considers necessary or advisable, including time periods for
payment of penalties and compliance with the bylaw;
9.1.4
To provide for payment of a reduced penalty if a compliance
agreement is entered into, as provided in Schedule “A”, attached
hereto and forming part of this bylaw; and
9.1.5
To cancel Bylaw Notices in accordance with the Act or City policies
and guidelines.

9.2
The bylaw contraventions in relation to which a Screening Officer
may enter into a compliance agreement are indicated in Column A3
of Schedule “B”, attached hereto and forming part of this bylaw.
9.3
The maximum duration of a compliance agreement is one (1) year.
SECTION 10
BYLAW ENFORCEMENT OFFICERS
10.1
Persons acting as any of the following are designated as Bylaw
Enforcement Officers for the purposes of this Bylaw and the Act:
10.1.1
Special constables, officers, members or constables of the Royal
Canadian Mounted Police;
10.1.2
Bylaw Enforcement Officers appointed pursuant to the Community
Charter and Police Act;
10.1.3
Local Assistants to the Fire Commissioner under Section 6 of
the Fire Services Act; and
10.1.4
Bylaw Enforcement Officers, licensing inspectors, building
inspectors, animal control officers or other persons acting in another
capacity on behalf of the City
for the purpose of enforcement of one
(1) or more of its bylaws.
SECTION 11
FORM OF BYLAW NOTICE
11.1
The City may from time to time provide for the form or forms of the
Bylaw Notice, provided the Bylaw Notice complies with Section 4 of
the Act.
SECTION 12
SEVERABILITY
12.1
If a portion of this bylaw is held to be invalid by a Court of competent
jurisdiction, then the invalid portion must be severed and the
remainder of this bylaw is deemed to have been adopted without
the severed section, subsection, paragraph, subparagraph, clause
or phrase.
SECTION 13
EFFECTIVE DATE
13.1
This Bylaw comes into force and takes effect on January 1, 2017.
